Navigating Brazilian patent law
Challenge
A global advisory firm requested support in developing a strategy to help a global corporation mitigate the implications of a landmark ruling by Brazil’s high court limiting patent exclusivity rights in the country to 20 years. The challenge posed was to assess the full scope of the decision and the prospects for obtaining judicial relief or, ultimately, reversal of the precedent. In addition, the client sought assistance in identifying alternative remedies, including federal policy or regulatory action, new legislation, or other forms of negotiated arrangements capable of offsetting the adverse effects of the court’s ruling.
Approach
-
Detailed analysis of the patent case to ferret out potential mitigating latitude or exceptions in the supreme court decision.
-
Review of pending court challenges to the patent decision to assess the outlook and expediency of litigation.
-
Survey of government agencies with a role in formulating, regulating, or implementing patent rules to gauge the possibility of compensatory federal action on patent rights.
-
Examination of the congressional docket to ascertain the introduction of any proposed legislative initiatives to neutralize the ruling's impacts.
-
Extensive stakeholder mapping to identify key senior-level policymakers for engagement on the possibility of reaching alternative arrangements to counterbalance the new patent regime.
Impact
With our guidance, the client was able to develop a comprehensive roadmap for navigating Brazil's patent landscape in light of the judicial decision. Our in-depth analysis of the legal, regulatory, and legislative scenario provided the insight needed to build a multi-tiered approach for proactively engaging on the issue in Brazil and crafting solutions. Similarly, through painstaking stakeholder mapping, we skillfully identified strategic actors positioned to advance mutually beneficial solutions capable of mitigating the company's risks and safeguarding its interests.
