As part of a comprehensive regional study on the intersection of infrastructure, sustainable development, and the environment in the Amazon Basin, an international policy research organization sought assistance in developing a stakeholder engagement mission to support the Brazilian component of its project study. A global advisory firm requested support in developing a  strategy to help a global corporation mitigate the implications of a landmark ruling by Brazil’s high court limiting patent exclusivity rights in the country to 20 years. The challenge posed was to assess the full scope of the decision and the prospects for obtaining judicial relief or, ultimately, reversal of the precedent. In addition, the client sought assistance in identifying alternative remedies, including federal policy or regulatory action, new legislation, or other forms of negotiated arrangements capable of offsetting the adverse effects of the court’s ruling.
